It is their Logo, Registered Trademark and Copywrite.
Under US law it is the owners responsibility to enforce their own Trademarks. If they do not, they stand a chance of loosing them to become public domain.
Then they would loose $$Millions.
If you think NASCAR or ISC is a hard *** on enforcement. You should try to use a Harley-Davidson name or logo without permission.
There will be lawyers at the door before the ink dries.

Hey Whatagal, if you find it so boring why are you in Nascar answering questions...to answer the original, Nascar is strict when they see the logo used without permission

It is what it is...But I do agree they can get their panties in a bunch over nothing when they should be more concerned about the health of the sport that makes it possible to have video games of it.

Not a NASCAR fan. Just don't get it - watching cars go round and round in a circle. I need more challenging sports.

Not only is the Nascar logo (banner in many cases) trademarked but so is the NR2K3 logo, as well as the Papyrus logo.

It's been a matter of time until it happened. Next ,sim painters such as myself will not be able to try to replicate a drivers car for the new mods without someone hitting us for copyright infringement.
